Acceptance of Terms

By accessing or using the Flyrix platform ("Service"), available at flyrix.app and operated by White Rabbit ("Company," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and White Rabbit.

If you do not agree to these Terms, you must not access or use the Service. By continuing to use the Service after any update to these Terms, you accept the revised Terms in their entirety.

Description of Service

Flyrix is a software-as-a-service (SaaS) marketing platform that provides tools for building sales funnels, running email campaigns, sending newsletters, managing marketing automation workflows, and selling digital products online.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

Accounts & Registration

Account Creation

To access certain features of the Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Age Requirement

You must be at least 18 years old to create an account and use the Service. By registering, you represent and warrant that you meet this age requirement.

Account Security

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any losses resulting from unauthorized use of your account.

One Account Per User

Each user may maintain only one free account. Creating multiple free accounts to circumvent service limits is strictly prohibited and may result in termination of all associated accounts.

Fees & Payment

Subscription Plans

Flyrix offers both free and paid subscription plans. Details of current plans, pricing, and included features are available on our pricing page. We reserve the right to change our pricing at any time with reasonable advance notice.

Billing

Paid plans are billed in advance on a monthly or annual basis, depending on the plan selected. All fees are non-refundable except as expressly required by applicable law or as stated in our refund policy.

Taxes

You are responsible for all applicable taxes, duties, or other governmental assessments associated with your use of the Service. We will collect VAT or similar taxes where required by law.

Failed Payments

If a payment fails, we may suspend or downgrade your account to the free tier until payment is successfully processed. Continued failure to pay may result in termination of your account.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to:

• Send unsolicited commercial messages (spam) or engage in any form of unauthorized email marketing;
• Violate any applicable local, national, or international laws or regulations, including data protection laws (e.g., GDPR);
• Upload, transmit, or distribute malicious code, viruses, or any harmful content;
• Infringe upon the intellectual property rights of any third party;
• Collect or harvest personal data without the explicit consent of the individuals concerned;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity;
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service;
• Attempt to gain unauthorized access to any systems, networks, or data related to the Service;
• Use the Service to promote or facilitate illegal activities of any kind.

We reserve the right to investigate potential violations and take appropriate action, including removal of content and termination of accounts.

Intellectual Property

Our Intellectual Property

The Service and all of its underlying components — including but not limited to software, design, logos, trademarks, text, graphics, and data — are the exclusive property of White Rabbit and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our prior written consent.

Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your own internal business purposes.

Feedback

If you submit suggestions, ideas, feedback, or other input regarding the Service, you grant us a perpetual, worldwide, royalty-free license to use and incorporate such feedback without any obligation or compensation to you.

User Content

You retain ownership of all content you create, upload, or transmit through the Service ("User Content"). By submitting User Content, you grant White Rabbit a limited, non-exclusive, worldwide license to store, host, and process such content solely as necessary to provide the Service.

You are solely responsible for your User Content and warrant that it does not violate any third-party rights or applicable laws. We may remove any User Content that violates these Terms or that we deem harmful, offensive, or otherwise inappropriate, without prior notice.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WHITE RABBIT EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
• Any warranty that the Service will be uninterrupted, timely, secure, or error-free;
• Any warranty that defects or errors in the Service will be corrected;
• Any warranty regarding the accuracy, reliability, or completeness of any information provided through the Service;
• Any warranty that the Service will meet your specific requirements or expectations.

We do not warrant that the Service will be continuously available. The Service may be subject to interruptions, outages, maintenance periods, or degraded performance due to factors within or outside our control — including but not limited to server failures, hosting provider issues, third-party service disruptions, or force majeure events.

White Rabbit assumes no responsibility and shall not be held liable for any damages, data loss, business interruption, or other harm arising from such interruptions or failures, regardless of whether they were foreseeable or we were advised of the possibility of such damages.

You use the Service entirely at your own risk. It is your responsibility to maintain appropriate backups and contingency plans for your data and business operations.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WHITE RABBIT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE TO YOU FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages;
• Loss of profits, revenue, data, business, or goodwill;
• Damages resulting from service interruptions, errors, bugs, or downtime;
• Damages resulting from unauthorized access to or alteration of your data;
• Any other damages arising out of or related to your use of or inability to use the Service.

These limitations apply regardless of the theory of liability — whether based on contract, tort, negligence, strict liability, or otherwise — and even if White Rabbit has been advised of the possibility of such damages.

In any event, our total cumulative liability to you for any claims arising under these Terms shall not exceed the greater of (a) the total fees paid by you to White Rabbit in the three (3) months immediately preceding the event giving rise to the claim, or (b) USD 50.

Indemnification

You agree to indemnify, defend, and hold harmless White Rabbit and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of or access to the Service;
• Your violation of these Terms;
• Your User Content or the content of your email campaigns, funnels, or other materials distributed through the Service;
• Your violation of any third-party rights, including intellectual property or privacy rights;
• Your violation of any applicable law or regulation.

Termination

Termination by You

You may terminate your account at any time by contacting our support team or using the account deletion option in your dashboard. Termination will take effect at the end of your current billing period for paid plans.

Termination by Us

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to the security or integrity of the Service or other users.

Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account data after a reasonable retention period, except where we are required to retain it by law. Provisions of these Terms that by their nature should survive termination will do so.

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region ("Hong Kong"), without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Hong Kong.

Before initiating any formal legal proceedings, you agree to first contact us in good faith and attempt to resolve the dispute informally within thirty (30) days. If the dispute cannot be resolved informally, the parties agree to submit to binding arbitration in Hong Kong in accordance with the rules of the Hong Kong International Arbitration Centre (HKIAC), unless otherwise required by applicable consumer protection law in your jurisdiction.

Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email (to the address associated with your account) or by posting a prominent notice on our website, and we will update the "Effective Date" at the top of this page.

Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and may terminate your account.
